Litigation Committee

Role: Design and implement the initiative’s litigation strategy to challenge Section 704 and other FCC preemptive actions and restore local and state authority over wireless infrastructure siting.

Duties and Responsibilities:

  • Develop Litigation Strategy: Develop and refine legal challenges to Section 704, and related federal preemption and constitutional doctrines.

  • Build and Manage Legal Team: Coordinate a team of expert attorneys with constitutional, administrative, environmental, and telecommunications law experience.

  • Oversee Litigation Activities: Oversee litigation filings, court appearances, discovery, appellate work, and legal analysis.

  • Collaborate with Allies: Collaborate with public interest legal organizations and advocacy partners.

  • Ensure Legal and Ethical Compliance: Ensure compliance with all legal and ethical standards while advancing a bold, coordinated legal strategy.

Ideal Candidates for the Litigation Committee:
We are seeking individuals who:

  • Are lawyers with expertise in constitutional law, administrative law, telecommunications law, environmental law, or public interest litigation.

  • Demonstrate a strong commitment to restoring local control, personal freedoms, property rights, and the states’ traditional police powers that protect health, safety, and welfare.

  • Are motivated to challenge the FCC’s outdated RF radiation guidelines and fight against federal regulatory overreach.

  • Possess litigation experience, including legal research and writing, motion practice, appellate work, or courtroom advocacy.

  • Can dedicate sufficient time to assist with litigation strategy development, research, expert coordination, and case management.

Experience challenging preemptive federal actions, litigating against regulatory overreach, or representing causes related to environmental health, civil rights, constitutional freedoms, or local governance is especially valued. Individuals with a track record of successfully advancing public interest litigation or defending community rights in the face of federal preemption will bring especially critical expertise to this effort.
